These Terms of Service ("Terms") govern access to fpdsp.com, operated by Bousmah Capital Investment LLC ("we," "us"). By creating an account or using the service, you agree to these Terms.
The service
fpdsp.com is a software platform for delivery service partners to track daily performance, forecast weekly outcomes, manage coaching workflows, and organize operational data. Forecasts and projections are estimates only — not official scorecard results or guarantees of future standing.
Accounts
You must provide accurate registration information and keep credentials secure. You are responsible for activity under your account. You must be authorized to act on behalf of the DSP you register.
Subscriptions & billing
Paid plans renew automatically unless canceled before the renewal date. Free trials convert to paid subscriptions unless canceled during the trial period. Fees are non-refundable except where required by law. We may change pricing with reasonable notice.
Your content
You retain ownership of data you upload. You grant Bousmah Capital Investment LLC a limited license to host, process, and display that data solely to provide and improve the service. You represent that you have the right to upload the content you submit.
Acceptable use
You agree not to:
- Use the service unlawfully or to violate third-party rights
- Attempt to access other users' data or probe system vulnerabilities
- Reverse engineer, scrape, or resell the service without permission
- Upload malware or content that disrupts platform operation
Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOUSMAH CAPITAL INVESTMENT LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT FORECASTS WILL MATCH OFFICIAL SCORECARDS OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOUSMAH CAPITAL INVESTMENT LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.
Termination
You may cancel at any time. We may suspend or terminate access for violation of these Terms or to protect the platform. Upon termination, your right to use the service ends; certain provisions survive.
Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where prohibited. Disputes will be resolved in courts located in Texas unless otherwise required by applicable law.
